Case description:

On March 27, 2023, five individuals who had been assessed overpayments of Federal Pandemic Benefits filed this a class action on behalf of themselves and others similarly situated (collectively, “plaintiffs”). The plaintiffs claim that the New Mexico Department of Workforce solutions made various errors in administering the pandemic relief program. The parties negotiated a settlement that was approved by the district court in Duran et al., v. New Mexico Department of Workforce Solutions, et al., D-101-CV-2023-00698. If you received pandemic unemployment benefits and were then assessed an overpayment by the Department, you may be a member of the settlement class.
