Bernalillo County Jail Consent Decree

As part of a class action settlement in McClendon, et al. v. City of Albuquerque, et al., 1:15-cv-00107-JAP-WPL, all detainees in the Metropolitan Detention Center have rights to certain conditions of confinement and certain standards for medical and mental health care. After years of litigation, the Court in McClendon entered the operative settlement agreement in this case in June of 2016. The purpose of the Settlement Agreement—together with its three attached Check-Out Audit Agreements—was to create workable standards to ensure constitutionally adequate conditions of confinement and to create a procedure for the defendants to come into compliance and end the lawsuit. Since 2016, various other orders have been granted to provide additional rights and remedies for detainees in MDC custody. Adam Flores and Henry Jones represent the plaintiff class together with attorneys from the Law Office of Alexandra Freedman Smith, the Law Office of Ryan J. Villa, Davis Law New Mexico, and the Law Offices of Nancy L. Simmons.
