How the state may infringe on individual religious liberties

The Constitution and the Amendments to it enshrine numerous crucial rights for those within the United States. The Constitution protects not just citizens but anyone in the United States dealing with government authority figures.

One of the most important protections established under the Constitution is freedom of religion. It is as important as freedom of speech and freedom of the press, which are also part of the First Amendment. People have the right to observe whatever religion they choose or no religion whatsoever.

The state should not penalize people for their religion or prevent them from practicing their faith. Unfortunately, some people experience inappropriate treatment that may infringe on their religious liberties.

What are some of the ways that people may experience a violation of their right to religious freedom?

Forced violations of religious precepts

People who belong to different faiths have to follow different practices. For example, Muslims are subject to dietary restrictions and daily prayer requirements. Jewish people also often have dietary restrictions they observe and rest requirements on the Sabbath. Certain denominations of the Christian faith impose restrictions on certain types of medical care and the foods the faithful eat.

Those in state custody in particular sometimes find themselves forced to violate the tenets of their faith. They are not given an opportunity to pray or receive inaccurate information about the food provided, which may then lead to a violation of their religion. In scenarios where state employees interfere in someone’s religious observances, possibly by tricking or forcing them into unwanted behavior, that could be a violation of their civil rights.

High-pressure attempts at conversion

Many religions value evangelization and religious conversion. Sometimes, those in a position of state authority might attempt to coerce others into altering their faith. Those in positions of authority, including police officers and correctional facility professionals, should not use that authority to try to manipulate people into altering their religious beliefs or observances.

Attempts to deprive people of their right to religious freedom could potentially provide grounds for a civil rights lawsuit under federal and New Mexico laws. Discussing a situation that may have deprived an individual of their religious liberties with a skilled legal team can help people determine whether the misconduct they experienced is actionable or not.
